Literature on categorization often invokes historical legacies to explain why states adhere to statistical categories that inadequately capture their population, and especially minority groups. The failure of the 2011 German census to produce reliable numbers on the country’s largest religious minority, Muslims, could be viewed as a case in point. However, this ignores the fact that in the late 1980s officials successfully counted Muslims. This article traces how officials changed their approach to Muslim enumeration over the course of designing the (...) 2011 census. Drawing on internal ministerial documents and interviews, I show that the reversal of statistical visibility was the result of a recoupling process. Through this process, old state-religion laws that officials had previously ignored now became rigorously applied to the census. An extra-statistical debate on religious education triggered this recoupling by reviving narrow, legal categories of religion and alerting church representatives and legal experts to imprecise census terms. Using the German case and other empirical examples, I describe a more uneven influence of historical legacies than commonly suggested by research on categorization. Rather than viewing legacies as having a stable, or even growing, influence on categorization, I argue that they only take effect when they become politicized and enforced by powerful actors. I call for a more nuanced analysis of the role historical factors play in determining trajectories of census categorization, especially those that are invoked to explain the reluctance of European states to collect ethno-cultural data. On Miranda Fricker’s influential account, the central case of testimonial injustice occurs if and only if the speaker receives a credibility deficit owing to identity prejudice of the hearer. Her critics have taken issue with her view, arguing that cases in which speakers are given more credibility than they deserve, may also amount to testimonial injustice. Furthermore, they argue, these cases cannot be captured by Fricker’s account of objectification as the primary epistemic harm of testimonial injustice; rather, it is an (...) account of othering that best captures a wide range of epistemic injustices. In this paper, I join Fricker’s critics in advancing a novel case of testimonial injustice through identity-prejudicial credibility excess – the adultification of black girls in testimony-giving settings. When testifying, black girls are likely to receive a credibility excess with respect to adult topics such as sex and consent because they are perceived as older, more self-reliable, and mature than they actually are by the hearers. Nevertheless, when examining the girls’ intersecting social identities defined by age, race and gender, it becomes clear that this constitutes an unjustly and prejudicially inflated estimation of their credibility. These cases also involve hermeneutical injustice since the identity-prejudicial credibility excess denies the victims a meaningful opportunity to make sense of their traumatic experiences of sexual assault. I conceptualize this compounded injustice as testimonial obfuscation, where an identity-prejudicial credibility evaluation (either in excess or deficit) causes an experience to remain unintelligible to the hermeneutically marginalized speaker. In an increasingly urbanized world, construction industry is called upon to serve the needs of human society, such as environmental protection and safety in terms of infrastructure. In this context, a sustainable and ethical development means a close connection between buildings and environment. This connection can be achieved through, for example, the concept of ecological concrete or green concrete, as it is often called. The conventional process of obtaining cement and mineral aggregates from the concrete composition generates pollution, especially through (...) greenhouse gas emissions. Also, one should not ignore the fact that extraction of the raw materials affects the habitats of the sites and of the neighboring areas. When construction materials are questioned, the ethical issues lay not in the means of expression, but mainly in the means of production. More to the point, the present contribution aimed to find solutions for enhancing the adhesion of vegetal aggregates with the cement matrix, in order to obtain a material with optimal mechanical properties, which is valued as an ethical approach of building industry. Results showed that plant aggregates can be used to obtain a building material which can be improved by using partial substitution of cement by silica fume, fly ash, or by using additives and that green concrete as an environmentally friendly material offers the alternative for lower energy use and fewer CO2 emissions. Marketers must understand not only the advantages of these green materials, but also that they have an ethical commitment to provide consumers with environmentally friendly materials. (shrink)

Adolescents who believe that their parents treat them differently from their siblings have poorer psychosocial well-being than otherwise. This phenomenon, which is known as parental differential treatment or PDT occurs in up to 65% of families. Past studies have examined socio-demographic variables (e.g., child gender, age, and birth order) as predictors of PDT, but these immutable characteristics do little to inform interventions and help these adolescents. Hence, this study extends past research by investigating links among parent empathy, parent perception of (...) PDT, child perception of PDT, child perception of fairness and child well-being (self-esteem, depression, anxiety, and trust in the relationship with parents). Furthermore, this study tests whether adolescent personality (openness, conscientiousness, extraversion, agreeableness and neuroticism), child empathy, and child perception of fairness moderate these links. This study will utilize a two-wave longitudinal design with a one-year lapse. Data will be collected from 760 Chinese adolescents studying from Secondary One to Secondary Three in 18 schools in Hong Kong and from their parents. We test our theoretical model via a multilevel structural equation model. This study both addresses (a) theoretical debates about relations among empathy, PDT, fairness, and psychosocial well-being and (b) focuses on modifiable factors and behaviors, to inform future interventions, such as parent education. The definition and measurement of the impact of laws and courts is a subject of disagreement and uncertainties. In this article, law is understood as a public, general, and binding command enforceable through state coercion. Assessments on the effects of laws on democracy and development focus on changes in specific social indicators. The evaluation of impact relates to the availability and reliability of judicial statistics and the impact of laws depends on political and social conditions. The interaction of laws can (...) be studied in three contextual variables: the structure and competitiveness of political systems, the structure and performance of the judiciary, and the organizational endowments of the social or political actors, such as social and labor movements that use the law. This interaction shows how and why certain conditions affect impact. El presente trabajo se centra en el concepto de espectador en Arendt entendido como narrador de la historia acaecida. La hipótesis de la presente investigación sostiene que la acción política se comprende en la conflictividad propia del mundo compartido o en común que encarna el narrador de la historia ; esto es, el sujeto de la acción política y crítica. Para sostener este principio es preciso comprender dos cuestiones. La primera es que en Arendt hay un sujeto que funda un (...) espacio sensible y visible y significa el sentido de la experiencia a través de la narración o relato. En segundo lugar, la experiencia narrada se visibiliza mediante la capacidad más política de todas: la de los juicios reflexivos kantianos entendidos como políticos arendtianos. Así, fundar el espacio de lo sensible como portador legítimo del significado de la acción política no instituye conceptos sedimentados tales como qué es actuar bien o mal o cómo hay que actuar bajo determinado régimen político. Más bien, son las indeterminaciones conceptuales propias del espacio político entendido como conflictividad a partir de los juicios, las que testimonian y definen un quién narrador o un espectador crítico de la acción. Esta última cuestión es la que se aproxima a un pensar político en Arendt dirigido a un planteo estrictamente filosófico y fenomenológico de la acción política. (shrink)

Se sostiene que los juicios reflexivos suponen un sujeto actuante que se determina por sus funciones discursivas. Para demostrar que hay un sujeto discursivo o narrativo en Arendt es preciso referir a las siguientes cuestiones. En primer lugar, hay una relación directa entre el sujeto político y su espacio de aparición o grado de publicidad. En este sentido, el sujeto no es cualquier sujeto. Es más bien el que tiene la posibilidad u oportunidad de aparecer frente a otros. Esta experiencia (...) conduce a pensar la acción humana en determinada dirección. El juicio reflexivo opera sobre un caso particular que hace posible la aparición del sujeto discursivo orientando la acción. En segundo lugar, el propósito de este análisis consiste en averiguar si es posible o legítimo pensar al discurso como recurso estrictamente narrativo y, en este sentido, indagar sobre la posición de Arendt al respecto: ¿se pueden pensar los juicios reflexivos a partir de lo narrado? Esta pregunta conduce a la conclusión del presente trabajo puesto que la posibilidad de pensar lo narrado a partir de los juicios reflexivos supone un sujeto específico con determinadas características previas que habilitan las categorías de lo visible, invisible, apariencia y realidad. Este artículo problematiza la forma en la que el feminismo ha interpretado al escepticismo como una amenaza para su proyecto epistemológico, ético y político, y plantea que, a pesar de dicha interpretación, el escepticismo es inherente a la filosofía feminista y un aliado útil para su proyecto. El problema ha estado en cómo el feminismo ha reducido su comprensión del escepticismo a una versión cartesiana extrema y ha pasado por alto otras corrientes de la tradición —como la de David Hume— (...) que podrían ser fructíferas para promover una actitud crítica y emancipatoria. Muestra así como una alianza entre una comprensión moderada del escepticismo y el feminismo puede brindar las herramientas necesarias para cuestionar formas de dominación patriarcal y poner en marcha investigaciones que combatan la opresión de género. The selfish goal metaphor is interesting and intriguing. It accounts for the idiosyncrasies and inconsistencies in peoples' goal pursuits without invoking free will, self-regulatory, or self-control failures. However, people pursue multiple goals, sometimes simultaneously. We argue that the model proposed in the target article may gain significant theoretical and practical value if the principles underlying goal selection and/or balancing on a moment-to-moment basis are clearly specified and integrated with the notion of the selfish goal.

Conversational artificial intelligence (CAI) presents many opportunities in the psychotherapeutic landscape—such as therapeutic support for people with mental health problems and without access to care. The adoption of CAI poses many risks that need in-depth ethical scrutiny. The objective of this paper is to complement current research on the ethics of AI for mental health by proposing a holistic, ethical, and epistemic analysis of CAI adoption. First, we focus on the question of whether CAI is rather a tool or an (...) agent. This question serves as a framework for the subsequent ethical analysis of CAI focusing on topics of (self-) knowledge, (self-)understanding, and relationships. Second, we propose further conceptual and ethical analysis regarding human-AI interaction and argue that CAI cannot be considered as an equal partner in a conversation as is the case with a human therapist. Instead, CAI’s role in a conversation should be restricted to specific functions. (shrink)

Often understood as a dissolution of the ego, mental illness implies a process of deconstruction where the psychotic faces the most frightening limits one can encounter: the limits of perception, the limits of understanding, the limits of vulnerability, and above all, the limits of intersubjectivity. The present paper aims to explore mental illness phenomenologically, taking it as both a limited and an unlimited experience of intersubjectivity. On the one hand, mental illness is widely regarded as a limited experience of intersubjectivity, (...) for it alters and hence limits access to the Other. But on the other hand, it can equally be taken as an unlimited experience of intersubjectivity, because it opens up a new world to the psychotic that can be transposed into and improved through artistic expression. The present article will bring together these two dimensions in order to reflect on the limits of experience in general. To do so, I will first address the clinical studies of the analyst Marguerite Sechehaye and of Rosemarie Samaritter. By retracing Marguerite Sechehaye’s deconstruction of the ego in a case of schizophrenia that she successfully treated, I attempt to circumscribe three distinctive experiential layers that have been disturbed by her patient’s mental illness: (1) the affective layer, (2) the symbolic layer, and (3) the kinesthetic layer, which is indicative of the fact that our spatial presence and body movements are constitutive elements of our sense of self and of our being in the world. Second, I will focus on the relationship between art and schizophrenia, and subsequently on the limits of experience that a psychotic transcends when undergoing his/her illness. (shrink)

En este artículo propongo una relectura de la novela Apuntes del subsuelo de Fiódor Dostoievski desde la mirada de la filosofía. Considerada por algunos la novela en la cual el escritor expuso su antropología; entendida, por otros, como una crítica social en boca de un extraño personaje, desde mi punto de vista esta obra es un ejercicio que desmantela la racionalidad moderna, y hace de Dostoievski un antimoderno. El ejercicio planteado parte de la idea que el filósofo ruso de origen (...) judío, Lev Shestov, afirmaba sobre este escrito: que representa la verdadera “crítica de la razón pura”. Trataré de demostrar que la novela Apuntes del subsuelo es uno de los escritos más filosóficos de Dostoievski, porque presenta la deconstrucción de la racionalidad moderna, para lo cual analizaré cómo entendió Dostoievski la razón y cuál fue su postura con relación con ella. This article presents an approach to the way in which Bolívar Echeverría, based on his reformulation of Marxist criticism, attempts to locate in the truncated configurations of Latin American modernity potentials for resisting the universal expansion of the value form. Drawing on his distinction between modernity and capitalism, as well as his interpretation of the fundamental tension between natural form and value form, the article exposes Exheverría’s historical analysis of the triumph of the realist ethos over the baroque ethos of (...) Latin American modernity. Nevertheless, the remnants of the latter constitute for Echeverría a possible counter-figure of the realistic ethos embodied by Whiteness. This is how his approach attempts to go beyond both Eurocentrism and the postmodern rejection of modernity, aiming to save the hope of a concrete universalism against the purely abstract universalism of capitalist modernity. This paper aims to restore, from the political thought of Merleau-Ponty, the rightful place of conflict. To achieve this hypothetical premise it is necessary to consider some issues that are woven into possible readings of the origin or foundation of politics. First, tracing back to the original cartesian proposition that the body is related with extensive substance invalid when detecting who we are. Then, considering the reading Merleau-Ponty makes of Machiavelli considering the notion of riot or mass under a conflicting (...) structure of politics in relation to the subject. In this regard, it is noted from this reading, the conditions proposed by Merleau-Ponty to highlight the importance of the singular in a politically shared space. And finally, to understand these problem areas of the history of philosophy as their own "world of life" where the contingent has a particular sense understood as the ontological place of the practical subject. Thus, in this context, it is possible to reconcile from Merleau-Ponty in the area of the contingent, body and language; what is felt and thought; perceived and settled. To understand the features of sedimentation helps to the formation of the localized subject; that is, it habituated or instituted. (shrink)

Lo hace al insertar ambos en las formas duales, pastorales y jurídicas, que desarrolla el gobierno eclesiástico plenomedieval para la condena de la inobediencia a la nueva ortodoxia y ortopraxis romana. A este respecto, los dispositivos confesional e inquisitorial se comprenden en relación con la emergencia de lo herético como impugnación obstinada al gobierno (...) romano –en la tensión entre el gobierno de sí y de los otros–. This paper confronts the medieval Church with Foucault´s conceptualization of Christendom in his writing on governmentality. In order to do so, this paper analyzes the formation of an ecclesiastical dual rule –jurisdiccional and pastoral– from the perspective of a genealogy of western political forms. For this purpose, a critical dialogue is stablished with Foucault’s analytics of pastoral power and of the subjectivation technologies involved in it. While the transformations supported by the pontifical power gave rise to the first western juridical (...) system, the ecclesiastical institution implemented services of c ura animarum throughout Christianity. Further, this salvation economy leaned on an unprecedented legal rule that turned pastoral power into a twofold rule, both sovereign and governmental. This paper argues that such an interpretation expounds the problems of the dichotomy government/sovereignity, on which Foucault founds his analytics of pastoral power and his genealogy of governmentality. This article seeks to provide a phenomenological inquiry into schizophrenia through which I propose to bring to the fore the mental violence exercised against the self in the case of a psychotic patient. My main aim is to show that a phenomenological analysis of mental illness, interpreted as a disintegration of the ego, can be very fruitful for understanding violence in general because it raises fundamental questions concerning intersubjectivity, intentionality, and self-awareness. In order to accomplish this objective, I will take (...) as my point of departure a case study of mental illness as presented by the analyst Marguerite Sechehaye, and I will explore, first, the phenomenological implications of the disintegration of the ego, and second, the dynamics of the reconstruction of the ego. Third, I will address the question whether mental illness is a form of violence against the self, sketching an answer by interpreting the transition from the disintegration of the ego to its reconstruction as an elevation from a poor phenomenon to a saturated phenomenon. Finally, I will suggest how opening a dialogue between phenomenology and psychoanalysis can contribute to understanding the phenomenon of mental violence. (shrink)

From the outset of scholarly research on Cusanus, the question concerning the historical status of his original philosophy has been a constant issue in thesecondary literature. One continuously encounters the question of whether he is a medieval or a modern thinker, with a number of conflicting interpretations. These viewpoints are, in many cases, less related to concrete historical arguments than to general considerations regarding what it is meant by “medieval” or “modern” from a theoretical point of view. This paper presents an interpretation of the paradoxical decision of Abraham done by Søren A. Kierkegaard in his work Fear and Trembling as an ethics of silence. The main idea is to understand ethics not as moral standards or specific duties, but as the responsibility of becoming a single individual in time; singularity as the intimate and personal relationship with the calling of love. In such a way, that silence is the experience of the encounter with the paradox that being (...) human means to be singular in conditions that claim an universal and general transparent manifestation dependent of the dominant rational discourse.Then, silence becomes the fundamental ethical claim to become a human person, as spirit in time, where it becomes a time of trial and examination, a temporality, where the trial is the fidelity to love’s calling, the listening of the possibilities that are presented by the anxiety of the decision. These possibilities are not immanent to the world or to history, they call for a personal choice, always containing a space of revelation; therefore of listening to the interiority of the personal choice that for Kierkegaard is the passion of faith, communicated and lived in silence. Concluding that an ethics of silence by the image of Abraham implies to re-think the role of philosophy in relationship to faith, hope and love in time, as a silent thought. (shrink)

Considered one of the most complex categories in Søren Kierkegaard’s thought, the repetition continues to raise much restlessness within his own authorship. Although about this category we find some first sketches in an unfinished book called Johannes Climacus or De homnibus dubitandum est, much later Kierkegaard will return to the category of repetition in his writing of the same name: Repetition, a peculiar work, very difficult to understand in its own dynamics. Resumen Si bien los cumplidos han sido examinados extensamente en diferentes idiomas, incluido el español, se ha prestado escasa atención al estudio de variación interdialectal en la realización de cumplidos. Es esto lo que nos interesa analizar en este trabajo al examinar cumplidos en dos variedades del español: español andino y español de Andalucía. Así, el estudio se enmarca en el área de pragmática variacionista. Más específicamente, con base en una muestra de 410 cumplidos que se obtuvieron empleando un cuestionario (...) de construcción de diálogos, analizamos similitudes y diferencias en la percepción de comportamiento apropiado al formular un cumplido entre mujeres universitarias en Quito y Sevilla. Como veremos, en cuanto a estrategias globales, en los dos contextos hay una preferencia clara por formulaciones directas, corroborando los resultados de estudios anteriores. Sin embargo, encontramos algunas diferencias tanto situacionales como socioculturales con respecto a las sub-estrategias empleadas en la realización del acto central. Identificamos también algunas diferencias en el empleo de mecanismos de modificación interna y actos de apoyo encaminados a realzar el cumplido. (shrink)

¿Cuáles son los márgenes de la cultura en la contemporaneidad? ¿Cómo se puede resistir desde estos? ¿Quiénes lo hacen o pueden hacerlo? Por supuesto, es imposible responder estas preguntas en esta corta presentación, tal vez sean imposibles de responder sin importar la extensión del texto que las analice. No obstante, nos parece necesario presentarlas para situarlas en un contexto que nos permita problematizar este dossier. Zygmunt Bauman4 planteó que tres campos de conocimiento: la filosofía de la historia, la antropología filosófica (...) y la estética, y un concepto: la cultura, emergieron en el siglo XVIII con el propósito de explicar la crisis de una forma de comprender y estar en el mundo, que se había pensado y vivido como natural y que parecía mutar en un orden radicalmente humano y, por ende, endeble, arbitrario y cambiante. Los acuerdos de paz concertados entre el gobierno colombiano y las FARC en 2016 se han visto no solo como la finalización del conflicto armado, sino como la posibilidad de imaginar y construir una sociedad inclusiva, justa y participativa. Se ha argumentado que los acuerdos de paz son la ruta más corta para lograr los objetivos del Estado democrático, y cumplir con lo estipulado en su narración como parte de un pacto social que conlleva a la convivencia pacífica. Sin embargo, (...) una mirada detallada y crítica a los lugares descriptivos y, por ende, prácticos a los acuerdos desde un punto de vista del feminismo centrado en la noción de diferencia revela en los acuerdos un sentido de exclusión y marginalización de la mujer que reproduce los marcos teóricos de un feminismo centrado en la igualdad y la equidad. El pensamiento filosófico de Luce Irigaray permite fracturar y descentrar las lógicas masculinas en la tradición filosófica de occidente y abre paso a la diferencia como concepto que recrea y re-imagina el espacio público y el marco político. Así, se posibilita una inclusión que fortalece la ciudadanía como derecho y como única garante de la reconciliación en la sociedad colombiana. (shrink)

El artículo defiende la posibilidad de una teoría de la acción animal en el planteamiento estoico apoyándose en la doctrina de la oikeiosis. El artículo afirma que, si bien los estoicos lantearon la existencia de impresiones, impulsos y asentimientos en el caso de los seres humanos y de los animales, el contenido que tienen dichos conceptos en cada uno de los ámbitos es sustancialmente diferente. En ese sentido, la exploración que se realiza permite, por un lado, identificar con mayor precisión (...) lo que es distintivo de los animales desde la perspectiva estoica y, por otro, mostrar cómo la comparación entre seres humanos y animales ratifica una unidad de criterio en la doctrina, según la cual los seres naturales se comportan conforme a su naturaleza.
